These Terms and Conditions (“Terms”) govern access to and use of AmericanFashionTV.com and any related content, forms, newsletters, videos, communications, and digital services operated by American Fashion TV (collectively, the “Services”).
American Fashion TV (“AFTV,” “we,” “us,” or “our”) is operated by AFTV, located in Atlanta, GA.
1. Acceptance of these Terms
By accessing or using the Services, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the Services.
Additional terms may apply to promotions, events, contributor relationships, advertising arrangements, memberships, purchases, or other services introduced in the future. If additional terms conflict with these Terms, the additional terms will control for the applicable feature or service.
2. Eligibility
The Services are intended for a general audience.
You must be at least 13 years old to use the Services. If you are under the legal age of majority where you live, you may use the Services only with the permission and involvement of a parent or legal guardian.
By using the Services, you represent that you are legally capable of accepting these Terms.

We may revise these Terms to reflect changes in our Services, technologies, business practices, or legal obligations.
When changes are made, we will revise the “Last updated” date. We will provide additional notice when required by law.

AFTV provides fashion journalism, interviews, commentary, criticism, analysis, cultural coverage, entertainment, and educational information.
Content may include opinions, predictions, commentary, or interpretations expressed by editors, contributors, interview subjects, or other third parties. Those opinions belong to the individuals expressing them and do not necessarily represent AFTV, its advertisers, or its partners.
Although we seek to provide accurate and useful information, fashion, technology, media, business, and cultural subjects can change rapidly. We do not guarantee that all information will remain complete, accurate, or current.
AFTV may correct, clarify, update, add context to, archive, or remove content at its discretion. Questions about a possible error may be sent to staff@maga-zine.com.

AFTV content is provided for general editorial and informational purposes. It does not constitute legal, financial, investment, medical, health, safety, or other professional advice.

Unless otherwise stated, this content is owned by AFTV or used with permission from licensors, contributors, service providers, or other rights holders. It is protected by copyright, trademark, publicity-rights, and other applicable laws.
Rights in third-party names, trademarks, photographs, recordings, products, designs, and other materials remain with their respective owners.
“American Fashion TV,” “AFTV,” associated logos, series names, and other brand elements may not be used in a manner suggesting sponsorship, endorsement, or affiliation without written permission.
8. Limited permission to use the Services
Subject to these Terms, AFTV grants you a limited, personal, revocable, nonexclusive, and nontransferable right to access and view the Services for lawful, noncommercial purposes.
You may share a standard link to a publicly accessible AFTV webpage, provided that you do not misrepresent the content or your relationship with AFTV.
Unless expressly authorized by AFTV or permitted by law, you may not:

Reproduce, republish, sell, license, or commercially exploit AFTV content;

Download, record, copy, or redistribute AFTV articles, videos, images, or graphics;

Remove copyright, trademark, attribution, watermark, or rights-management information;

Circumvent technical measures intended to protect content or limit access.
These restrictions do not prohibit ordinary search-engine indexing authorized by AFTV or lawful uses that cannot be restricted, including applicable fair-use or fair-dealing rights.

9. Artificial intelligence and synthetic media
AFTV explores fashion in the era of digital media and artificial intelligence. We may use AI-assisted tools for research, transcription, translation, captioning, editing, image production, ideation, or other production activities.
AFTV may also publish or discuss:

AI-generated or AI-assisted images;

Synthetic or altered media;
-
Virtual models and digital influencers;
-
Digital fashion;
-
Composited imagery;
-
AI-assisted audio or video; and
-
Demonstrations of emerging technologies.
Where appropriate, AFTV may label or explain material uses of generative AI or synthetic media. Disclosure practices may evolve as technologies and industry standards change.
Illustrative or digitally created material should not automatically be interpreted as documentary evidence of an actual person, collection, product, endorsement, or event.
You may not reuse AFTV content in a deceptive way or use it to misrepresent real people, brands, products, statements, or events.
10. Sponsored content, advertising, and affiliate relationships
The Services may contain advertisements, sponsored content, paid partnerships, affiliate links, gifted products, product placements, or other commercial relationships.
Where required, AFTV will identify sponsored or advertising content using disclosures such as “Advertisement,” “Sponsored,” “Paid Partnership,” or similar language.
If AFTV may receive a commission from a purchase made through a link, an affiliate disclosure may appear near the applicable content or link.
Advertising does not necessarily constitute AFTV’s independent endorsement of an advertiser, product, service, or claim. Advertisers and third-party sellers are responsible for their products, services, representations, offers, warranties, and fulfillment.
Transactions with third parties are solely between you and the applicable third party. Review that party’s terms, return policies, warranties, and privacy practices before completing a transaction.
11. Third party links and embedded content
The Services may link to or embed content from social-media platforms, video providers, designers, brands, retailers, publishers, museums, archives, advertisers, or other independent parties.
Links and embeds may be provided for editorial context or convenience. AFTV does not control and is not responsible for third-party content, availability, security, accuracy, products, services, or privacy practices.
A link, reference, or embed does not necessarily mean that AFTV endorses or is affiliated with the third party.
Your use of an independent third-party service is governed by that party’s terms and privacy policy.
12. Forms, pitches, and other submissions
The Services may allow you to submit an inquiry, partnership request, advertising request, story idea, contributor pitch, feedback, photograph, video, document, or other material (“Submission”).
By making a Submission, you represent that:

The information you provide is accurate;

You have the necessary rights and authority to provide it;

It does not violate another person’s intellectual-property, privacy, publicity, or contractual rights;

It is not unlawful, fraudulent, defamatory, threatening, or malicious; and

It does not contain malware or harmful code.
Do not send highly sensitive personal information through a general website form.
You retain ownership of original material in your Submission. You grant AFTV a nonexclusive, worldwide, royalty-free license to receive, store, copy, review, and internally share the material as reasonably necessary to evaluate and respond to it.
AFTV does not obtain the right to publish an original article, photograph, or video publicly merely because it was submitted through a general inquiry form. Publication requires separate permission, a contributor agreement, or other clear authorization.
Unsolicited ideas and pitches are not confidential unless AFTV agrees otherwise in writing before submission. AFTV may already be developing similar ideas and has no obligation to use, compensate, or respond to an unsolicited proposal.
13. Interactive features and accounts
If AFTV introduces comments, reader accounts, saved content, memberships, or other interactive features, you are responsible for:

Providing accurate account information;

Protecting your login credentials;

Restricting unauthorized access to your account;

Notifying AFTV of suspected unauthorized access; and

Activity conducted through your account.
AFTV may moderate, reject, remove, or restrict user content or accounts that violate these Terms or create legal, security, or operational risks.
AFTV is not required to retain accounts, comments, submissions, or other user-generated material indefinitely.
14. Prohibited conduct
You may not use the Services to:

Violate applicable law or another person’s rights;

Harass, threaten, defame, exploit, or impersonate another person;

Submit fraudulent, deceptive, or misleading information;

Introduce malware or harmful code;
-
Attempt unauthorized access to accounts, systems, or information;

Probe or test website vulnerabilities without written authorization;

Interfere with website availability, performance, or security;

Overload the Services through automated requests;
-
Collect personal information about other users;
-
Send spam or unauthorized marketing;
-
Manipulate analytics, engagement, traffic, or advertising results;

Circumvent access or security restrictions;
-
Scrape or create an unauthorized database of AFTV content;

Use AFTV content for unauthorized AI training or commercial purposes;

Misrepresent an association with AFTV; or
-
Encourage or assist another person in prohibited conduct.
15. Email communications
If you subscribe to an AFTV newsletter or marketing email, you agree to receive the communications described at signup.
You may unsubscribe using the link in an email. Unsubscribing from promotional messages does not prevent AFTV from responding to an inquiry or sending necessary administrative communications.
Email delivery is not guaranteed. Providers may delay, filter, or block messages.
16. SMS and MMS messaging terms
This section applies only if you separately opt in to receive text messages from AFTV.
Program identity
The messaging program is called American Fashion TV Updates.
Depending on the specific opt-in selected, messages may include:

Editorial alerts;

New article or video notifications;
-
Event announcements;
-
Responses to inquiries;
-
Partnership communications;
-
Promotional messages; or
-
Other communications described in the applicable opt-in form.
Marketing and nonmarketing messages may use separate consent options. Accepting these general Terms does not by itself constitute consent to receive automated marketing messages.
Consent and frequency
You will receive text messages only after providing the applicable affirmative consent or otherwise initiating a communication where a response is permitted by law.
Consent to receive marketing text messages is not a condition of purchasing a product or service.
Message frequency varies. Message and data rates may apply.
Opting out
You may cancel the messaging service at any time by replying STOP to a message. After you send STOP, we may send one confirmation message stating that you have been unsubscribed. No further messages will be sent unless you subsequently opt in again or applicable law permits a response.
To rejoin the program after opting out, complete the applicable AFTV opt-in process again.
Carrier disclaimer
Wireless carriers are not responsible for delayed or undelivered messages. Message delivery depends on your carrier, device, service availability, and other factors outside AFTV’s control.
You are responsible for maintaining an active mobile service and for charges imposed by your carrier.
Messaging privacy
Information collected through the messaging program is handled in accordance with our Privacy Policy.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information may be provided to subcontractors that support the messaging service, such as platform, delivery, and customer-service providers. Text message originator opt-in data and consent will not be shared with third parties for their own purposes.
17. Copyright complaints
AFTV respects intellectual-property rights.
If you believe material available through the Services infringes a copyright you own or are authorized to enforce, send a written notice to:

Knowingly making a material misrepresentation in an infringement notice may result in liability.
If AFTV intends to rely on the safe-harbor provisions of the Digital Millennium Copyright Act for user-generated content, it should separately designate and register a DMCA agent with the U.S. Copyright Office.
18. Availability and modification of the Services
We may change, suspend, discontinue, restrict, or remove any part of the Services at any time.
We do not guarantee that the Services will always be available, uninterrupted, secure, or free from errors. Maintenance, technical problems, security events, third-party services, or circumstances beyond our control may affect availability.
AFTV is not obligated to retain any specific article, video, feature, archive, Submission, or webpage permanently.
19. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
AFTV DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT.
AFTV DOES NOT WARRANT THAT:

THE SERVICES WILL MEET YOUR REQUIREMENTS;

CONTENT WILL ALWAYS BE ACCURATE, COMPLETE, OR CURRENT;

ACCESS WILL BE UNINTERRUPTED OR ERROR-FREE;

DEFECTS WILL BE CORRECTED; OR
-
THE SERVICES WILL BE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.
20. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AFTV AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRIBUTORS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM OR RELATED TO THE SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, AFTV’S TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF:

The amount you paid directly to AFTV for the applicable Service during the 12 months before the event giving rise to the claim; or
-
One hundred U.S. dollars (US $100).
These limitations apply regardless of the legal theory and even if AFTV was advised that damages were possible.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
21. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless AFTV and its owners, officers, employees, contributors, contractors, and service providers from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys’ fees arising from:

Your unlawful use of the Services;

Your violation of these Terms;

Your Submission;
-
Your infringement or violation of another person’s rights; or
-
Your fraud, misconduct, or negligence.
AFTV may assume control of the defense of a matter subject to indemnification, and you agree to cooperate reasonably with that defense.
22. Suspension and termination
AFTV may restrict, suspend, or terminate access to the Services if we reasonably believe you have:

Violated these Terms;
-
Created legal, operational, or security risk;

Infringed another person’s rights;
-
Used the Services fraudulently; or
-
Engaged in conduct harmful to AFTV, its users, or its partners.
You may stop using the Services at any time.
Sections that by their nature should survive termination—including intellectual-property, disclaimer, liability, indemnification, and dispute provisions—will survive.
23. Governing law and jurisdiction
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules.
Subject to any rights you have under mandatory consumer-protection law, legal proceedings arising from these Terms or the Services must be brought in the state or federal courts located in Cobb County, Georgia. You and AFTV consent to the personal jurisdiction of those courts.
Nothing in this section deprives a consumer of protections that cannot be waived under the law of the consumer’s residence.
24. General provisions
Entire agreement
These Terms, the Privacy Policy, and any applicable additional terms constitute the entire agreement between you and AFTV concerning the Services.
Severability
If a provision is found invalid or unenforceable, it will be enforced to the greatest extent permitted, and the remaining provisions will remain effective.
No waiver
AFTV’s failure to enforce a provision is not a waiver of that provision or any other right.
Assignment
You may not assign your rights or obligations under these Terms without AFTV’s written permission. AFTV may assign its rights and obligations in connection with a merger, reorganization, sale, transfer, or operation of the business.
No third party beneficiaries
These Terms do not create rights for anyone other than you and AFTV, except where expressly stated.
